The federal advisory opinion on the immunization protection of medical professionals related to the countermeasures covered by COVID-19 was assisted by the Advanced Living Industry Association.
Argentum led the work to obtain an advisory opinion on the “Public Preparedness and Emergency Preparedness” or “Prep” bill issued by the Ministry of Health and Human Services on January 8. The opinion emphasizes that health care providers should take responsibility for protection when prioritizing the distribution of countermeasures (including COVID-19 vaccine), especially if it is done in accordance with public health guidelines.
An Argentum spokesperson said: “The advisory opinion believes that the prioritization or purposeful allocation of targeted measures (such as therapeutic agents or vaccines) may be affected by the protection of the PREP Act, especially if the public health authorities Instructions to proceed,”
The opinion believes that the covered countermeasures include any products approved or authorized by the Food and Drug Administration or the U.S. Occupational Safety and Health Administration, including the COVID-19 vaccine.
Elderly communities, nursing homes and other medical institutions face lawsuits related to the use or non-use of targeted countermeasures against COVID-19, including personal protective equipment and COVID-19 vaccination. Long-term care workers said they are following the CDC’s recommendations on priority populations for the COVID-19 vaccine and public health guidelines on infection control and prevention.
In the early stages of the pandemic, Alex Azar the HHS Secretary, had issued under the PREP law a new declaration, that was originally signed into law in 2005 to provide medical professionals with extensive immune protection and provide targeted Covert countermeasures against coronavirus.
The statute does not include those who “willfully acted inappropriately,” which means that in addition to criminal prosecution, they may also face potential civil liability.
